Have a question that is not covered here? Call or WhatsApp us on +91 96508 09956.
Who can file a delayed-payment case?
Micro and small enterprises registered under Udyam can file against buyers who have not paid on time. Generally, the protection applies to supplies made while the enterprise was registered.
How much time does a buyer have to pay?
Payment is due by the agreed date, but the agreed period cannot exceed 45 days from the day of acceptance. If no date is agreed, payment is due within 15 days.
What interest can I claim?
The Act provides for compound interest, with monthly rests, at three times the bank rate notified by the Reserve Bank of India, from the date the payment became due.
What happens after the case is filed?
The Facilitation Council first attempts conciliation. If the dispute is not settled, it can proceed to arbitration.
